By accessing nuvaloans.com or submitting a request through it, you agree to these Terms of Use and to the NuvaLoan privacy policy.
These terms form a legal agreement between you and NuvaLoan ("NuvaLoan," "we," "us," or "our"). If you do not agree, do not use the website or submit a request. Our privacy policy explains how we collect and share your information and is part of these terms.
Please note: these terms include a binding individual arbitration provision and a class action waiver, which affect how disputes are resolved. You may opt out as described below.
Eligibility to Use the Service
You must be at least 18 years old and a resident of the United States to use the NuvaLoan service.
By using the website, you confirm that you meet these requirements and that you have the legal capacity to enter into this agreement. Lenders set their own eligibility rules, which may include a higher minimum age in some states, a valid Social Security number, a steady source of income, and an active checking account. Meeting our eligibility requirements does not mean a lender will consider or approve your request.
Nature of the Service
NuvaLoan is a free matching service that passes your request to lenders in its network; it is not a lender, charges you no fee, and places you under no obligation.
- We do not make credit decisions, issue loan offers, or fund loans.
- We do not act as your agent or recommend any particular lender or product.
- You pay nothing to submit a request, and you are free to decline any offer.
- We do not promise approval, a match, a particular rate, or any specific loan amount or term.
Lenders and lending networks compensate us, as explained in our advertiser disclosure.
Your Submissions Must Be Accurate
You agree that all information you submit is true, complete, current, and your own.
Submitting false information, or information about another person without authorization, is prohibited and may be unlawful. You authorize NuvaLoan, and the lenders and service providers we share your request with, to verify the information you provide, including through consumer reporting agencies, identity verification services, and fraud prevention databases.
Consent to Communications
By submitting a request, you agree that NuvaLoan and matched lenders may contact you by phone calls, text messages, and email, including by automated means, at the contact details you provide.
Calls and texts may be made using an automatic telephone dialing system or prerecorded or artificial voice messages, even if your number is on a do-not-call registry. Your consent is not a condition of purchase or of obtaining any loan or product. Message and data rates may apply.
You may revoke consent at any time by replying STOP to a text message, using the unsubscribe link in an email, or contacting us. Revoking consent with NuvaLoan does not revoke consent you gave to a lender; contact each lender separately. You agree to tell us promptly if a phone number you provided is reassigned or disconnected.
Third-Party Lenders and Their Terms
Any loan you accept is governed solely by the agreement between you and the lender, not by these terms.
Lenders and their websites operate independently of NuvaLoan and have their own terms, privacy policies, rates, fees, and practices. We are not responsible for a lender's decisions, disclosures, conduct, or servicing of your loan. Review each lender's documents carefully before you sign, and direct questions about payments or loan servicing to the lender.
No Promise of Approval
We do not promise approval; not all requests will be matched with a lender, and not all matched requests will receive an offer.
Offers, if any, may be for a different amount, rate, or term than you requested. Rate ranges, examples, and estimates shown on the website are for general information and do not represent an offer of credit.
Intellectual Property
The website and its content, including text, graphics, logos, and design, belong to NuvaLoan or its licensors and are protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to view the website for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from any part of the website without our written permission. The NuvaLoan name and logo may not be used without our consent.
Prohibited Uses
You may use the website only for lawful purposes and only to submit a genuine request for yourself.
You agree not to:
- submit false, misleading, or another person's information;
- use bots, scrapers, or other automated tools to access or collect data from the website;
- interfere with, disrupt, or attempt to gain unauthorized access to the website or its systems;
- upload or transmit malicious code;
- use the website to commit fraud or violate any law;
- resell or commercially exploit the service or its content.
We may suspend or end your access to the website at any time if we believe you have violated these terms.
Disclaimers
The website and service are provided "as is" and "as available," without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, NuvaLoan disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We make no promise that the website will be uninterrupted, error-free, or free of harmful components, or that any lender will respond to your request. Content on the website is general information, not financial, legal, or tax advice.
Limitation of Liability
To the fullest extent permitted by law, NuvaLoan is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website or service.
This includes damages arising from a lender's decisions or conduct, any loan you enter into, or the loss of data or profits. Because the service is free to you, our total liability for any claim relating to these terms or the website will not exceed one hundred dollars ($100). Some states do not allow certain limitations, so some of these limits may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless NuvaLoan and its officers, employees, and agents from claims arising from your misuse of the website or violation of these terms.
This includes reasonable attorneys' fees and costs resulting from inaccurate information you submit, your violation of any law, or your infringement of another party's rights.
Governing Law
These terms are governed by the laws of the State of Nebraska and applicable federal law, without regard to conflict-of-law rules.
The Federal Arbitration Act governs the arbitration provision below. For any matter not subject to arbitration, you agree to the jurisdiction of the state and federal courts located in Douglas County, Nebraska.
Dispute Resolution and Arbitration
If a dispute arises, you agree to first try to resolve it informally with us, and if that fails, to resolve it through binding individual arbitration rather than in court, unless you opt out within 30 days.
Informal resolution
Before starting arbitration, send a written description of your claim and the relief you seek to our mailing address or email. Both sides will try in good faith to resolve the dispute within 60 days.
Binding individual arbitration
Any unresolved dispute relating to these terms or the website will be settled by binding arbitration before a neutral arbitrator under the consumer rules of a nationally recognized arbitration provider. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative action. You and NuvaLoan each waive the right to a jury trial. Either party may bring an eligible individual claim in small claims court instead.
Your right to opt out
You may opt out of this arbitration provision by sending a written notice to NuvaLoan, 8805 Ashbury Commons Blvd, Suite 285, Omaha, NE 68102, or to [email protected], within 30 days after you first submit a request or first use the website. Include your name, address, email, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these terms.
Changes to These Terms
We may update these terms from time to time, and the updated version applies from the time it is posted on this page.
If we make material changes, we will post a notice on the website. Changes will not apply retroactively to disputes of which we already had notice. Your continued use of the website after an update means you accept the revised terms.
